Whatever ones views about the Schiavo case this is a very very bad attempt to find an answer. Habeus Corpus is not the right legal doctrine for figuring out what to do with incapacitated persons in private hospitals, nursing homes or hospices. Hearings have now been scheduled – next week – by the slowest body in the world, which is moving fast to consider measures aimed at ‘saving’ Terri Schiavo through just that doctrine. We have the proposed bill, and this is the planned hearing:
